Acceptance & Eligibility
These Terms of Use ("Terms" or "Agreement") constitute a legally binding contract between you or the commercial fitness business you legally represent ("Gym Owner", "Customer", or "you") and DeveloperChowk("GymElite", "we", "our", or "us").
By subscribing to a GymElite SaaS plan, signing up for a 7-day free trial, accessing our web workspace, or connecting WhatsApp integrations, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.
Account Security & Staff Roles
Gym owners are solely responsible for managing workspace credentials and defining staff permissions:
- Credential Confidentiality: You must maintain strict confidentiality of owner login credentials. You are responsible for all activities occurring under your workspace.
- Role-Based Staff Access: You may provision sub-accounts for trainers, front-desk receptionists, and branch managers. You agree to configure permissions appropriately to restrict unauthorized access to confidential revenue reports.
- Notification of Breach: You agree to notify GymElite immediately at [email protected] if you suspect unauthorized access or security compromise.
WhatsApp Messaging & Anti-Spam Policy
GymElite provides automated WhatsApp messaging infrastructure designed to send digital bills, payment receipts, and membership expiry reminders directly from your linked gym phone number:
• Messages may only be dispatched to members, clients, or leads who have willingly provided their phone numbers directly to your fitness facility.
• You shall NOT use GymElite to broadcast unsolicited mass spam, lottery messages, predatory loan advertisements, or scraped phone directories.
• Violation of Meta WhatsApp Business Policies or sending unsolicited bulk spam may result in immediate suspension of your WhatsApp connection.
QR Gate & Attendance Policy
GymElite provides contactless mobile QR check-in and biometric hardware integration capabilities:
- Anti-Proxy Enforcement: Members scan the desk QR code, which temporarily compares device GPS coordinates with the gym's geofenced perimeter.
- Gate Access Restrictions: The software automatically warns staff or halts check-in when a membership has expired or has outstanding fee dues. Gym owners remain solely responsible for deciding whether to permit entry to members with overdue balances.
- Hardware Independence: GymElite operates on standard smartphones, tablets, and computers. Third-party biometric turnstiles and scanners are supported via API, but hardware maintenance remains the gym's responsibility.
Subscriptions & Lifetime Price Lock
GymElite offers flexible subscription durations (3 Months, 6 Months, and 12 Months) with transparent Indian Rupee (₹) pricing:
When you subscribe to any GymElite plan, the discounted subscription fee you lock in today is permanently guaranteed for as long as your workspace remains active. We will NEVER arbitrarily hike renewal fees on active gym subscribers.
- 7-Day Free Trial: All new gym owners receive full-featured access for 7 days without requiring a credit card or upfront deposit.
- Cancellation: You may cancel or pause your subscription at any time prior to the next billing cycle.
- Taxes: All listed prices are exclusive of applicable Goods & Services Tax (GST) unless explicitly noted otherwise.
Customer Data Ownership
You retain 100% full legal ownership of all proprietary customer records, member phone numbers, payment records, attendance logs, and workout assignments uploaded to your GymElite workspace.
AI Diet & Workout Disclaimer
GymElite includes an AI Nutrition & Workout Engine that generates educational meal templates and exercise split suggestions.These AI-generated templates do NOT constitute medical advice, nutritional therapy, or clinical diagnosis.
Gym owners, certified fitness trainers, and athletes are solely responsible for reviewing any AI diet plan before implementation, particularly for members with underlying health conditions, food allergies, or medical constraints.
Service Availability & 99.9% SLA
We target 99.9% application uptime across all core services (member check-in, billing recording, and database access). Scheduled maintenance is conducted during low-traffic overnight hours (01:00 AM – 04:00 AM IST) with prior dashboard notice whenever feasible.
Limitation of Liability
GymElite functions solely as an administrative software platform provider. To the maximum extent permitted by applicable Indian law:
- Facility Operations: The gym owner remains solely responsible for the physical safety of their premises, trainer conduct, exercise equipment maintenance, and health waivers signed by gym members.
- Cap on Damages: GymElite's aggregate financial liability arising out of or relating to this Agreement shall strictly not exceed the total subscription fees actually paid by the gym owner during the preceding three (3) months.
Suspension & Data Export on Exit
You may terminate your GymElite subscription at any time through the dashboard or by contacting support:
- 30-Day Export Grace Period: Following subscription expiration or voluntary cancellation, your workspace enters a 30-day read-only grace period during which you can download complete member and financial ledgers.
- Suspension for Cause: We reserve the right to suspend accounts that engage in fraudulent chargebacks, unauthorized system reverse-engineering, or illegal spamming activities.
Governing Law & Jurisdiction
This Agreement shall be governed by and construed in accordance with the substantive laws of the Republic of India. Any dispute, controversy, or claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts situated in Uttar Pradesh, India.
